In this respect, patents owners are required to pay their annuities, including upcoming ones online.
Each annuity should be paid separately and individually. After the Patent Office accepts the same and the prescribed fees are paid, patent owners can pay the subsequent annuities.
Annual maintenance fees are due on the anniversary of International filing date for PCT applications and late years annuities (accumulated annuities) are paid at the time of filing or within 3 months of the national phase entry without any consequences for settling the due annuities or within a 3-months grace period with a late payment fine and subsequent annuities are paid at the beginning of each year subsequent to the year of entry phase of the patent application in Kuwait starting 1 January to 31 March of every year with a 3 months grace period up to 30 June with a late penalty fees.
Annuities for non-PCT applications (convention patents) are due on the anniversary of the national filing date (including both priority and non-priority applications) and are paid every year subsequent to the year of filing the patent application in Kuwait within 1 January to 31 March every year with a grace period of 3 months till 30 June with a late penalty fee.
It is not obligatory to pay the annuities through the recorded agent of service as this type of payment can be carried out by any other agent without the recordal of change of agent or a power of attorney. Failure to pay the annuity fees within the prescribed deadlines will automatically cause the lapse of the application and no provision for restoration.
