CNIPA Re-structures its Patent Office and Trademark Office

26th February, 2019

On 14 February 2019, the China National Intellectual Property Administration (CNIPA, previously SIPO) announced its reconstruction.  According to the announcement, a “big” Trademark Office and a “big” Patent Office will be organized under CNIPA.

The “big” Trademark Office will include the following offices:

  • The Trademark Office under the previous State Administration of Industry and Commerce;
  • The Trademark Review and Adjudication Board (TRAB) under the previous State Administration of Industry and Commerce;
  • Trademark Examination Coordination Center under the previous State Administration of Industry and Commerce.

The “big” Patent Office will include the following offices:

  • The Patent Office under the previous SIPO;
  • The Patent Re-examination Board under the previous SIPO.

With such reconstruction, the stamps of these offices and some of the application forms will be replaced with new ones from 1 April 2019. Such new forms will be available online from 1 March 2019 at www.cnipa.gov.cn for patents and http://sbj.saic.gov.cn for trademarks. However, the locations of the offices and the procedure of specific cases will remain the same.
