“Proposed new Rule 856 EPC”

FICPI, the International Federation of Intellectual Property Attorneys, broadly representative of the free profession throughout the world, assembled at its Executive Committee held in Rio de Janeiro, Brazil, 1980, passed the following Resolution:

FICPI welcomes and supports the proposal that the EPO should grant an extension of time in the event of omission to request examination and pay the examination fee, the applicant paying for such an extension with a surcharge of 50%. This failure has a much more severe effect on the applicant than the failure to meet a term for paying the application fee, the designation fees and the search fees. Such a new Rule would be an essential complement to Rule 85a which has already been introduced and which allows a 2 months extension for paying the application, designation and search fees with a fine.
