TM&D 3 // When IP and Social Media Collide

The types and extent of IP available for fashion designs differ from jurisdiction to jurisdiction, and may include not only design patents and trademarks, but also copyrights.
 

In addition to obtaining this protection, essential in the consideration of a global brand strategy are licensing of those rights, restriction of sales on third party internet sites, and the exploitation of social media by authorised and unauthorised users of the brand and the brand’s products.  

Highlighting a recent court decision of a well-known wedding dress designer, the session will also touch on rights of publicity with respect to the use of these IP tools.

This session will not only provide an overview of the types of IP protection available, but will also provide guidance on what has, and has not been successful in implementing collaborative agreements that are omnipresent in the fashion industry.
