In this session FICPI Focus 45 moderator Louis-Pierre Gravelle will discuss the “Draft Interagency Guidance Framework for Considering the Exercises of March-in Rights” under the Bayh-Dole Act with former Chief Judge of the U.S. Court of Appeals for the Federal Circuit, Judge Paul Michel.

The National Institute of Standards and Technology (NIST) released draft interagency guidance for public comment. The draft guidance encourages funding agencies to consider both the practical impact and the potential impact of exercising march-in rights. 

As the USPTO says: For more than 40 years, the Bayh-Dole Act has promoted the commercialisation of federally funded research & technology. Recently there have been calls for greater clarity on when it is appropriate or warranted for a federal agency to exercise its march-in rights.
