Nevin’s greatest satisfaction as an IP attorney is having the opportunity to help innovators and creators to safeguard their ideas and inventions.

In particular, he feels particularly rewarded when his efforts protect their hard work.

“While the written law remains the same for all, its interpretation can differ widely based on facts. As a patent attorney, it’s incredibly fulfilling to have the opportunity to influence and reshape these interpretations.”

In a recent case, Nevin’s firm handled negotiations between a startup and a research institute. 

The immediate dispute focused on the distribution of net income. However, Nevin points out that the problems began many years earlier with an inadequate pre-research agreement. 

“This situation might have been easily resolved if both parties had considered the commercial implications before committing to three years of research and successfully filing patents.” 

United Trademark & Patent Services was able to assume the role of legal advisor for both parties to reach an amicable solution through a pragmatic and collaborative approach.

“This experience reinforced the idea that successful negotiation is not a zero-sum game. Fortunately, all parties exercised sound judgment, leading to a positive outcome.”

The future for independent IP attorneys

Like many of his fellow members of FICPI’s global community, Nevin is exploring how Artificial Intelligence (AI) impacts the work of an independent IP attorney, in particular how it integrates with other technologies.

“As AI tools advance, they will help automate tasks like prior art searches and patent drafting, enabling attorneys to concentrate more on strategic planning and client engagement. 

“Furthermore, the emergence of digital platforms for IP registration and enforcement will require attorneys to adjust their methods and provide more tech-savvy solutions. 

“This shift will also demand a deeper understanding of how technology impacts IP rights, ensuring that we remain at the forefront in a fast-changing environment.”

 

Value of FICPI membership

Nevin joined FICPI in 2022 and has been an active contributor in such a short time. As well as being a member of CET 3 Study & Work Group, which focuses on international patent matters, he represented FICPI at the launch of the Global Innovation Index in 2023 and during the 36th WIPO session at the Standing Committee on the Law of Patents.

He says the value of FICPI membership lies the collaboration and networking with a diverse array of professionals from around the global community – and supports his firm’s culture of continuous learning.

While Nevin observes that IP is not merely a job, it’s a passion, he does enjoy opportunities to step back and reflect, while engaging his spiritual side.

“Activities such as painting, music, swimming, playing chess, go beyond mere self-expression - they also allow me to connect deeply with my inner self. 

“These creative endeavors help me rise above daily concerns, recharge my energy, and gain a new perspective on my professional life. 

“Additionally, I deeply value the time I spend with family and friends, whether we're enjoying a meal together, having meaningful discussions, or simply enjoying each other's company. 

“Ultimately, taking time to disconnect and reflect serves as a spiritual practice that helps me reconnect with my core beliefs, gain valuable insights, and return to my professional responsibilities with a fresh sense of direction and clarity.”
